  1. IMPORTANT: By installing the software onto your HPC, you are consenting 
  2. to be bound by this License Agreement. 
  3. If you do not agree to the terms of the License Agreement, do not copy 
  4. any of the files contained onto your HPC.
  5.  
  6. ATTENTION: the timing accuracy of oPenStop depends on the windows timer 
  7. and the system clock of your HPC and is therefore not suitable for any 
  8. critical time measurements and may vary on different hardware plattforms 
  9. and software configurations !
  10.  
  11. oPenCE Stopwatch  END USER License Agreement
  12.  
  13. This oPenCE Stopwatch software ("Software") is owned by 
  14. oPen Software Systemberatung GmbH. ("oPen"). oPen hereby grants to the 
  15. user a temporary, non-exclusive license to use this Software solely for 
  16. internal purposes.  User shall not commercially distribute, sub-license, 
  17. resell, or otherwise transfer for any consideration, or reproduce for 
  18. any such purposes, the Software or any modification or derivation 
  19. thereof, either alone or in conjunction with any other products or 
  20. programs.  Further, the user shall not disassemble, reverse engineer, 
  21. modify, decompile, or otherwise abuse the intended purpose under this 
  22. License Agreement. 
  23. The user may evaluate the Software for 30 days. After that he must 
  24. either register the Software, download a newer version or seize using 
  25. the Software and permanently remove the Software from his HPC.

  27. This Software is provided to the user "AS IS." oPen assumes no risk if 
  28. this Software does not function properly or operate error free and oPen 
  29. makes no warranties, either expressed or implied, with respect to the 
  30. Software and/or associated materials provided to the user, including 
  31. but not limited to any warranty of merchantability or fitness for a 
  32. particular purpose. Further, oPen shall not be liable for any claims 
  33. or damages whatsoever, including property damage, personal injury, 
  34. intellectual property infringement, loss of profits, or interruption 
  35. of business, or for any special, consequential or incidental damages, 
  36. however caused, whether arising out of breach of warranty, contract, 
  37. tort (including negligence), strict liability, or otherwise.

  39. oPen reserves the right at any time to change prices, specifications, 
  40. features, licensing terms, release dates, general availability or 
  41. other characteristics of the Software without further notification to 
  42. the user.

  44. This Agreement is governed by the laws of the Federal Republic of 
  45. Germany. If any provision of this Agreement shall be unlawful, void, 
  46. or for any reason unenforceable, then that provision shall be deemed 
  47. severed from this Agreement and shall not affect the validity or 
  48. enforceability of the remaining provisions of this Agreement. 
  49. This Agreement is the complete statement of the agreement and 
  50. supersedes any proposal or prior communications between oPen and the 
  51. user relating to the subject matter of this Agreement.
